Please Read These Terms Carefully Before Using this Service. 

THE HIGHLIGHTS
*The MSCA PF BOOTCAMP is a course that has been designed to support the preparation of a proposal for the Marie Sklodowska-Curie Postdoctoral Fellowship scheme, specifically for researchers in the social sciences and humanities.

*The course resources consist of 12 video lessons, three live group coaching sessions via Zoom, and one 45-minute individual coaching session.

*By purchasing the course you are being given access for one person; sharing your login details or access to the course with anyone other than yourself constitutes a breach of these terms and conditions.

* You understand that Natalie Papanastasiou provides feedback and advice to the best of her knowledge, and it is up to you to independently verify and process the advice provided.

* You agree to hold Natalie Papanastasiou harmless from all damages.

TERMS & CONDITIONS OF PURCHASE

You are purchasing access for one (1) person to the MSCA PF Bootcamp (referred to below as the “MSCA PF Bootcamp,” or the “Course”) from Natalie Papanastasiou (the “Owner,” “she,” or “her”).

The Product includes live course access, course content and materials, other information and materials furnished by Natalie Papanastasiou (collectively, “Content”) and access to a membership platform hosting the Course (the “Site”). By purchasing access to the Course, you and the Company hereby agree to these Terms and Conditions of Purchase and the Owner’s Terms of Use and Privacy Policy (collectively, this “Agreement”) following legal terms and conditions that govern your use of the MSCA PF Bootcamp and that form a legal agreement between you and the Owner. In the event of any conflict between these Terms and Conditions of Purchase and the Terms of Use or Privacy Policy, these Terms and Conditions of Purchase shall control.

THE SECTIONS BELOW TITLED “BINDING ARBITRATION” AND “CLASS ACTION WAIVER” CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. THEY AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM.

The MSCA PF BOOTCAMP

The MSCA PF BOOTCAMP is a Course that has been designed to support the preparation of a proposal for the Marie Sklodowska-Curie Postdoctoral Fellowship scheme, specifically for researchers in the social sciences and humanities.

By purchasing the Course, Participants are given access to its resources until 14 September 2023 (the day after the deadline for the 2023 MSCA PF Call). On 14 September, Participants’ access to the Course platform will be permanently removed.

Course Participants are given access to pre-recorded video lessons that are available via their Participant access to the Course website. The Owner has the right to modify or remove any of these videos at any time.

Course Participants are also given access to three live group coaching sessions. These coaching sessions are open to all Participants and will last for one hour each. They will be recorded and uploaded onto the private Course platform. The recordings will not be shared on any other platform or with any third party. While Natalie Papanastasiou is committed to providing the live coaching sessions at the dates listed on the Course platform, she reserves the right to change or cancel any of these dates. In the event of a cancellation, the Owner will do her very best to re-arrange the coaching session to take place at a different date.

Course Participants are also given the option to have one 45-minute individual coaching session with Natalie Papanastasiou. In order to maximise the benefit of this coaching call on the Participants’ proposals, these individual coaching sessions are required to take place before 4 August 2023. Also, the meetings will need to take place at a time that is between 08:00 and 16:00 Central European Summer Time. All Participants will liaise with Natalie Papanastasiou individually in order to find a mutually convenient time for this meeting. 

Payment Policy
You are responsible to pay for the MSCA PF Bootcamp fee (545 Euros Early Bird fee or 700 Euros Full fee) in full. The payment can either be done via the Course website using a valid credit card, or via bank transfer using the details provided by Natalie Papanastasiou on an invoice.  

Refund Policy
Refunds are not offered for this Course. If you are unsatisfied with your experience, please email natalie@outstandingresearchgrants.com regarding your concerns.

Intellectual Property
You agree that the MSCA PF Bootcamp contains proprietary Content that is owned by the Owner and/or her licensors and is protected by copyright, trademark, and other applicable intellectual property laws. Duplicating, sharing, or uploading any Product Content, including to any sharing or social media sites, is considered stealing.

The Owner provides you with the Course solely for your personal, non-commercial use, and you agree that you will not use any of the Product Content in any way whatsoever except for use in compliance with this Agreement. You will not use the Course or the Content available in the Product in a manner that constitutes an infringement of the Owner’s rights or that has not been authorized in writing by the Owner. More specifically, unless explicitly authorized in this Agreement, you may not modify, copy, reproduce, republish, upload, post, transmit, rent, lease, loan, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the MSCA PF Bootcamp. 

To be clear: please be aware that you may not create derivative works, resource guides, marketing or business materials, source material, intellectual property, websites, blogs, web content, or any other works that reference the Owner, MSCA PF Bootcamp, or MSCA PF Bootcamp Content, or infringe on any of the Owner’s intellectual property in any way. All copyrights, trademarks, and other intellectual property rights in and to the Course (including the compilation of Content, postings, links to other internet resources, and descriptions of those resources) are owned by the Owner and/or her licensors, which reserve all of their respective rights in law and equity. THE USE OF THE OWNER’S COURSE, EXCEPT AS PERMITTED IN THIS AGREEMENT, IS STRICTLY PROHIBITED AND INFRINGES ON THE INTELLECTUAL PROPERTY RIGHTS OF THE OWNER AND OTHERS AND MAY SUBJECT YOU TO CIVIL AND CRIMINAL PENALTIES, INCLUDING POSSIBLE MONETARY DAMAGES, FOR COPYRIGHT AND OTHER INFRINGEMENT.

The MSCA PF Bootcamp includes access for one (1) person. Upon registration, you will receive one username and password for the Site for use during the Course.

If you would like to take the Course along with a partner or collaborator, you will need to purchase the course individually.

Privacy and Confidentiality
The Course is subject to the Owner’s Privacy Policy.

We respect your privacy and must insist that you respect the privacy of other people that participate in the Course.

By purchasing access to the Course, you agree:

  • not to infringe any copyright, patent, trademark, trade secret or other intellectual property rights of the Owner or the Course Participants;
  • that any confidential information shared by the MSCA PF Bootcamp Participants or any of the Owner’s representatives is confidential and proprietary and belongs solely and exclusively to the Participant who discloses it or to the Owner;
  • that all live group coaching sessions via Zoom will be recorded and made available to Course Participants via the Course website;
  • not to disclose such confidential information to any other person or use it in any manner other than in discussion with other MSCA PF Bootcamp Participants during live coaching sessions;
  • that all Content provided to you by the Owner is the Owner’s confidential and proprietary information and intellectual property, belong solely and exclusively to the Owner, and may be used by you only as authorized by the Owner;
  • the reproduction, distribution and sale of the Content by anyone other than the Owner is strictly prohibited; and
  • that if you violate, or threaten to violate, any of your agreements contained in this paragraph we will be entitled to, among other things, injunctive relief to prohibit such violations.

While you are free to discuss your personal results from the Course and training, you must keep the experience and statements, oral or written, of all other participants in the strictest of confidence.

Third-Party Materials and Websites
The Owner may provide links to third-party materials and websites as a convenience to you and other MSCA PF Bootcamp Participants. These third-party materials and websites are not part of the MSCA PF Bootcamp, and they may be either withdrawn or terminated at any time without notice to you and without any liability on the part of the Owner. You agree that you will be responsible for all other obligations associated with your use of any and all third-party materials and websites. In addition, you agree that the Owner is not responsible for examining or evaluating the content or accuracy of any third-party materials and websites, and the Owner does not warrant and will not have any liability or responsibility for any third-party materials, websites, products, or services of third-parties. You further agree that you will not use any third-party materials and websites in a manner that would infringe or violate the rights of any other party and that the Owner will not be liable for your improper use of third-party materials and websites.

Disclaimer
THE MSCA PF BOOTCAMP, THE SITE, THE CONTENT, AND ANY OTHER MATERIALS PROVIDED BY US HEREUNDER ARE PROVIDED “AS IS” AND “AS AVAILABLE” BASIS.

The Owner has taken all reasonable efforts to ensure that she accurately represents her Course and its potential to improve your grant writing skills. However, the Owner does not guarantee that you will get any results using any of our ideas, tools, strategies or recommendations, and nothing in the Course, Content, or Site is a promise or guarantee to you of future success.

YOU EXPRESSLY AGREE THAT YOUR USE OR INABILITY TO USE THE MSCA PF BOOTCAMP IS AT YOUR SOLE RISK. By purchasing access to the Course, you accept, agree, and understand that you are fully responsible for your progress and results from your participation and that we offer no representations, warranties, or guarantees verbally or in writing regarding your grant funding, or results of any kind. You alone are responsible for your actions and results which are dependent on personal factors including, but not necessarily limited to, your skill, knowledge, ability, dedication, scientific and technical acumen, to name just a few. You also understand that any testimonials or endorsements by our customers or audience and the results experienced by individuals may vary significantly. Any statements outlined on the Owner’s website, Courses, Content, and offerings are simply her opinion and thus are not guarantees or promises of actual performance. The Owner offers no professional legal, medical, psychological, or financial advice.

Additional Terms and Conditions
1) GOVERNING LAW. You and the Owner have entered into this Agreement in the Hellenic Republic of Greece and agree that the validity, interpretation, and legal effect of this Agreement, as well as all disputes among you and the Owner, shall be determined in accordance with the laws of the Hellenic Republic of Greece, without regard to conflicts of law principles that would dictate the application of the law of a different jurisdiction.

2) LIMITATION OF LIABILITY. IN CONNECTION WITH ANY WARRANTY, CONTRACT, OR COMMON LAW TORT CLAIMS: (I) THE OWNER, OR HER LICENSEES SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR OUT OF THIS AGREEMENT, INCLUDING YOUR USE OF THE MSCA PF BOOTCAMP.

AS SET FORTH IN HER PRIVACY POLICY, THE OWNER SHALL USE REASONABLE EFFORTS TO PROTECT INFORMATION SUBMITTED BY YOU IN CONNECTION WITH YOUR PURCHASE AND USE OF THE MSCA PF BOOTCAMP, BUT YOU AGREE THAT YOUR SUBMISSION OF SUCH INFORMATION IS AT YOUR SOLE RISK.

3) NON-DISPARAGEMENT. You agree that you will not engage in any conduct or communications with a third party, public or private, designed to disparage the Owner or the MSCA PF BOOTCAMP including, but not limited to, any remark, comment, message, information, declaration, campaign, communication, or other statement of any kind, whether verbal, in writing, electronically transferred, or otherwise, that might reasonably be construed to be derogatory, defamatory, libelous, or slander.

4) BINDING EFFECT. This Agreement shall be binding upon, and inure to the benefit of, the successors, executors, heirs, representatives, administrators, and permitted assigns of the parties. You have no right to assign this Agreement, by operation of law or otherwise. The MSCA PF BOOTCAMP is a non-transferable program.

5) TERMINATION. The Owner is committed to providing all customers in the Course with a positive Course experience. If you fail, or the Owner suspects that you have failed, to comply with any of the provisions of this Agreement, the Owner, in her sole discretion and without notice to you, may: (a) limit, suspend, or terminate your participation in the MSCA PF BOOTCAMP without refund; and/or (b) terminate this Agreement.

Your obligations to the Owner under this Agreement will survive expiration or termination of this Agreement for any reason.

6) CHANGES. The Company reserves the right at any time to modify this Agreement and to impose new or additional terms or conditions on your use of the Course. Such modifications and additional terms and conditions shall be effective immediately and incorporated into this Agreement. Your continued use of the Course will be deemed your acceptance thereof. The changes may be listed in an area accessible to you on the Site or you may be notified by e-mail. If you have any questions, please contact natalie@outstandingresearchgrants.com.

7) INDEMNIFICATION. You agree to defend, indemnify, and hold harmless the Owner, her licensors, related entities, affiliates, and successors from and against any and all liabilities and expense whatsoever, including, without limitation, claims, damages, judgments, awards, settlements, investigations, costs, attorneys’ fees, and disbursements, which any of such parties may incur or become obligated to pay arising out of or resulting from your breach of this Agreement and/or your misuse of the MSCA PF BOOTCAMP. You shall defend the Owner in any legal actions, regulatory actions, or the like arising from or related to this Agreement. You recognize and agree that all of the Owner’s employees, shareholders, trustees, affiliates, and successors shall not be held personally responsible or liable for any actions or representations of the Owner.

8) EQUITABLE RELIEF. You acknowledge and agree that in the event of a breach or threatened violation of the Owner’s intellectual property rights and confidential and proprietary information by you, the Owner will suffer irreparable harm and will therefore be entitled to injunctive relief to enforce this Agreement. The Owner may, without waiving any other remedies under this Agreement, seek from any court having jurisdiction any interim, equitable, provisional, or injunctive relief that is necessary to protect her rights and property pending the outcome of the arbitration referenced above. You hereby irrevocably and unconditionally consent to the personal and subject matter jurisdiction of the federal and provincial courts in the Hellenic Republic of Greece for purposes of any such action by the Owner.

9) ENTIRE AGREEMENT. This Agreement constitutes the entire understanding and agreement of the Parties with respect to its subject matter and supersedes all prior and contemporaneous agreements or understandings, inducements, or conditions, express or implied, written or oral, between the parties.

10) COMPLIANCE WITH LAW. The parties shall comply with all applicable laws in performing this Agreement. Whenever there is any conflict between any provision of this Agreement and any applicable law, the applicable law shall prevail.

11) NO WAIVER. The failure of any party to insist on the performance of any obligation hereunder shall not be deemed to be a waiver of such obligation. Waiver of any breach of any provision shall not be deemed to be a waiver of any other breach of such provision or any other provision.
